We at Talent for Schools (TFS) are committed to protecting your privacy and providing a safe online experience with our site. Because we gather certain types of information about the users of TFS, we believe you should fully understand our information gathering and dissemination practices. This privacy statement discloses what information we gather, how we use it, and how to correct or change it.
Our site's registration form requires you to enter contact information (such as your name and email address). We will not disclose any of your personal information to any outside parties except with your consent as described in the Personal History section below.
You may store your personal information such as previous employers, education, and resume in our database. This stored information can be used by you to fill out applications for jobs posted on our site without ever having to retype the information. You will always have the option of changing your information for a particular job application before submitting it to a prospective employer.
Your information can also be used by our employer clients to find qualified job applicants through our searchable resume database. You have the option as to whether or not you want to allow your information to be searchable by employers.
We track number of times jobs posted on our site are displayed, but only in the aggregate. We do not track which individual users display a particular job.
We may use your IP address to help diagnose problems with our servers, and to administer our Web site. We will not track any other information regarding your IP address.
Changing or Deleting Information
You may change any of your contact or personal information at anytime. You may also use the Your Account option to delete your registration information including your contact and personal information. You are always welcome to re-register with us at a later date.
For Partner Schools/Employers:
TFS provides a web-based service where employers can advertise to and communicate with a database of individuals and prospective employees. The terms and conditions (“terms”) set forth below govern the Employer’s and its representatives’ use of the TFS website and services and are legally binding on the Employer. In order to use this service, an authorized representative of the Employer must accept the following terms and conditions.
If the Employer does not agree with any of these terms, its representatives shall not access or otherwise use the TFS website or services. The Employer’s representatives’ use of the TFS website or services shall be deemed to be the Employer’s agreement to abide by the terms set forth below. It is the responsibility of the Employer to inform its representatives of these terms.
Information pertaining to individuals found through TFS is confidential and will not be shared with anyone outside of the Employer. The Employer will not distribute, disclose or transfer information to third parties unless compelled to by law.
The Employer will not provide services in competition with or substantially similar to the services provided by TFS.
The Employer understands that TFS does not screen or verify any information provided by the individuals listed on its website. Therefore, the Employer is responsible for conducting its own search into the background, qualifications and credentials of any individual it chooses to hire.
Except as expressly stated herein, the Employer acknowledges that the Employer has no right, title or interest in or to any copyrights, trademarks, logos, graphics or images on TFS.
The Employer is prohibited from taking any action to circumvent or attempt to circumvent the security and access control provisions of TFS. The Employer acknowledges that it may not:
- Provide false or misleading information on TFS or to TFS
- Use TFS to violate any applicable law or regulation, or violate the privacy or publicity rights of any other person.
- Post any information that is abusive, defamatory, discriminatory, hateful, obscene, vulgar, sexually-orientated, threatening, or otherwise objectionable.
- Harass, stalk, or otherwise subject any user of TFS and/or its services to unwanted and/or inappropriate contact.
- Post any position or business opportunity which requires payment from the applicant or requires recruitment of other individuals, sub-distributors or sub-agents such as a multi-level marketing scheme, pyramid scheme, franchise or distributorship arrangement.
- Use TFS and/or its services and/or its materials for any purpose other than to identify prospective employees for employment opportunities.
- Make any changes, additions and/or deletions to any submissions posted by any user without the express written authorization of such other user.
- Intentionally expose TFS and/or its services to any computer virus or any other program or code intended to disrupt or disable to operations of the website or its services.
- Use any robot, spider or other program or device to retrieve or index any portion of the TFS website;
- Harvest or otherwise collect information about users for any purpose other than use of TFS and/or its services as expressly permitted herein.
The foregoing list of prohibitions is illustrative and is not intended to be complete or exclusive. TFS reserves the right to terminate our relationship with the Employer under these Terms and prohibit the Employer’s access to TFS and/or its services or to edit, remove or close any posting by the Employer for any reason.
To the fullest extent possible by law, in no event shall TFS, its suppliers, affiliates, partners, representatives, officers, directors, agents, employees or any third parties mentioned on TFS be liable for any claim or demand for damages whatsoever (including, without limitation, incidental and consequential damages, direct, indirect or special damages, lost profits, exemplary, or punitive damages or damages resulting from lost data, lost employment opportunity or business interruption) resulting from the Employer’s use, misuse, inability to use or reliance on the TFS services, website or content or arising from any claim relating to these terms of service, relationship with a third party, or relationship with TFS, whether based on warranty, contract, tort, or any other legal theory, and whether or not TFS is advised of the possibility of such damages and notwithstanding the failure of essential purpose of any remedy. Such limitation of liability shall apply whether the damages arise from information posted on the TFS website, from inability to use the TFS services or website, or from the interruption, suspension, or termination of the TFS services or website. This limitation shall also apply with respect to other services or links found on TFS. This limitation shall also apply to the costs of procurement of substitute goods or services, lost profits, or lost data. This limitation shall also apply, without limitation, in the event that the Employer’s account or information entered by the Employer, its users or its applicants is accessed, disclosed, altered, deleted, or compromised. While TFS uses safeguards designed to protect the data entered into its system, it cannot guarantee that the security measures it has in place will never be defeated, compromised, or fail, or that the measures will be sufficient or effective. The Employer understands and agrees that it assumes all responsibility and risk for its use of TFS such limitation shall apply notwithstanding any failure of essential purpose of any limited remedy and to the fullest extent permitted by law.
The Employer agrees to indemnify and hold harmless TFS and its affiliates, representatives, partners, officers, directors, agents and employees from any claim or demand, including reasonable attorneys' fees, made by any third party due to the violation by the Employer of any law of the rights of a third party.
Disclaimer of Warranty
To the fullest extent possible by law, the TFS website, information, services, materials, and content are provided on an “as is” basis without any warranties of any kind. TFS disclaims all warranties, whether express or implied, and statutory warranties, including, without limitation, the warranties of merchantability, fitness for a particular purpose, and non-infringement of proprietary rights. TFS makes no warranties about the accuracy, quality, suitability, truth, security, reliability, completeness, performance or timeliness of the TFS content, services, software, text, graphics, or links. TFS and its licensors disclaim any warranties for any information or advice obtained through the TFS services. If use of TFS, or its content, results in the need for servicing or replacing equipment or data or any other costs, TFS is not responsible for those costs.
Choice of Law
This agreement shall be governed by the laws of the State without the application of its conflicts of laws principles. In the event of any dispute between the parties, such dispute shall be resolved by binding arbitration in accordance with the rules for commercial arbitration of the American Arbitration Association. In the event of a dispute, controversy or claim arising out of or relating in any way to these Terms or otherwise between parties, the complaining Party shall notify the other Party, in advance of filing a demand for arbitration, in writing. The hearing shall be conducted in the City, unless both parties consent to a different location. The decision of the arbitrator shall be final and binding upon all Parties.
The prevailing party to any dispute will be entitled to the receipt of reasonable attorney's fees and costs related to collecting an arbitrator's award. Any questions involving contract interpretation shall use the laws of the State. An arbitrator's decision may be entered in any jurisdiction in which the party has assets in order to collect any amounts due hereunder.
If any provision of these Terms is found to be invalid by any court having competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of these Terms, which shall remain in full force and effect. No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term. In addition, TFS’s failure to enforce any term of these Terms shall not be deemed as a waiver of such term or otherwise affect TFS’s ability to enforce such term at any point in the future.
This agreement constitutes the entire understanding of the parties with respect to the subject matter, supersedes all prior written or oral agreements, and may be modified in writing at any time, without notice.
The Employer fully understands and agrees to the above listed terms and conditions.
